1. General Warranty Conditions

1.1.
Generally ENERMAX products are guaranteed to operate as specified by their datasheet and in the operating environment for which they were designed to. ENERMAX guarantees its end users that purchased products, which are covered by the respective warranty, to be free from material and manufacturing defects. The guarantee does not affect the statutory warranty claims, but justifies additional, separate claims against ENERMAX. The ENERMAX warranty does not cover possible transportation costs to the responsible service partner or the ENERMAX customer support facilities. 

1.2.
Service will be done in the form, that parts which have defects in material and workmanship, in spite of adequate treatment and attention to the instructions for use, on our option will be repaired or exchanged. Replaced devices are transferred to our property. All RMA returns will be tested by ENERMAX upon return. If the product is found to be non-defective, it may be returned to the end user without service or replaced with an equivalent used or repaired product. Alternatively, ENERMAX reserves the right to exchange the defective device or component for a successor product or refund the purchase price less a usage fee. 1.3.
The warranty is valid only for end users with the original invoice, who bought the ENERMAX product from an authorized dealer. The ENERMAX warranty cannot be transferred. Guaranteed services for second-hand products are rejected. The warranty has to be claimed at the original dealer or responsible service partner. If the original dealer no longer exists, contact with ENERMAX customer service is necessary. The end user bears the costs of returning the defective products to the dealer or service partner.

 

2. Warranty Period

The warranty period starts from the date of purchase shown on the original invoice (initial purchase by consumers at authorized ENERMAX dealer). Neither warranty service does cause an extension of the original warranty period, nor does it start a new guarantee. The warranty period for installed spare parts ends with the warranty period for the device.

3. Warranty Service

ENERMAX provides regional warranties to applicable countries on all products sold within official retail channels. This warranty is only valid and applicable to official products and in countries where the products have been officially released and are licensed by ENERMAX for sale and purchase. Warranties are not transferable and will become void for products purchased from one region and transported to a different region.

Global warranty is currently unavailable.
If your products need to be returned within the warranty period, please do so through the official retailer or distributor from whom you purchased the product. 

If you are no longer able to receive service from your original retailer, dealer or distributor, please contact ENERMAX Support (http://www.enermax.com.tw/en/contact). ENERMAX will evaluate the claim and on approval will issue an RMA number and further instructions.

4. Warranty Requirements and Exclusion

It is important to note that our warranty is not an unconditional guarantee. The Warranty does not cover events including but not limited to:

  1. Original invoice or copy of invoice including purchasing date, model name and complete company data of the dealer including the tax number or VAT ID is indispensable and has to be included when sending in for RMA service. All RMA requests without original invoice or copy of invoice will be rejected.
  2. Product has to be within the statutory warranty period since purchasing date (cases, peripherals, enclosures) or within 3, 5 or 10 years warranty period (power supplies only).
  3. Warranty period cannot be transferred to another owner.
  4. Warranty is immediately lost, when the product is opened, modified or deliberately damaged.
  5. If the device is damaged or destroyed by force majeure or environmental influences (humidity, heat, electric shock, overvoltage, dust, etc.), no warranty can be given.
  6. Warranty cannot be claimed for PSUs that have been used outside of the technical specification (for example: mining).
  7. Warranty cannot be claimed if the PSU was used in improper operation, including any use that is not in accordance with any supplied product instructions.
  8. Warranty cannot be claimed for wear and tear associated with normal use.
  9. No warranty can be claimed for damage to the device or the connected hardware if cables other than the original cables, which are supplied together with the power supply, were used.
  10. Spare cables (purchased from ENERMAX) or cables recommended by ENERMAX support are excluded from this regulation.
  11. Any unsuitable environment or use of the product (including cryptocurrency mining) is not covered by warranty.
  12. Any product which has been modified without permission from ENERMAX, or in which the serial number has been modified, defaced, or removed.
  13. Accidental abuse, misuse, neglect, fire, water, lighting, or any act of nature, failure to follow instructions, shipping or transport damage (claims must be made with the carrier), and any other cause, which does not relate directly to a product defect.
  14. Any product is transferred to a third party.
  15. Any product purchased on eBay, Marketplace.
  16. Damage due to acts of nature, such as lightning, flood, fire, earthquake, thunder, an unusual voltage or environmental factors.
  17. Product malfunction or damage resulting from spilled liquids, moisture, stains, or dampness.
  18. Repair or attempted by another party but not authorized by ENERMAX.
  19. Connection to an incorrect voltage supply.
  20. Any other cause which does not relate to a product defect in materials or workmanship.
  21. Use of parts and components not supplied by ENERMAX.
  22. Third-party products using ENERMAX components will not be covered by warranty.
  23. Usage not in accordance with ENERMAX product instructions.
  24. Shipping, handling damages, and charges.
  25. ENERMAX does not warrant that this product will meet your requirements. It is your responsibility to determine the suitability of this product for your purpose.
  26. As one of the items in this product’s packaging, if there is any inappropriate use of the modularized cables that causes any damage both within the product itself and/or any other damaged parts, they will not be covered by this product’s warranty.
  27. When returning product, please be sure to enclose a clear description of the problem and your proof of purchase with the defective product and return it as instructed and ship it postpaid.
  28. ENERMAX will not accept the defective product without prior approval and RMA number.

 

5. Limitation of liability

ENERMAX is liable for loss or damage to your product only when ENERMAX is in possession of the product or when the product is in transit, provided that ENERMAX is responsible for transportation. 
ENERMAX is NOT responsible for the loss or disclosure of data, including confidential, proprietary or personal information contained in a product. 
To the extent permitted by law, in no event and regardless of a breach of the essential purpose of any limited remedy provided herein, shall ENERMAX, its affiliates, suppliers, resellers or service providers be liable for any of the following even if advised of their possibility and whether or not the claim is based on the contract, warranty, negligence, strict liability or any other theory of liability:
1) claims by third parties against you for any damage;
2) the loss, damage or disclosure of your data;
3) special, incidental, punitive, indirect or consequential damages, including, but not limited to, loss of profits, business income, property or anticipated savings. 
In no event shall the total liability of ENERMAX, its affiliates, suppliers, resellers or service providers for damages of any kind exceed the amount of actual direct damage or the amount paid for the product.
The above limitation does not apply to personal injury (including death), damage to real estate or tangible movable property for which ENERMAX is liable under the law.

 

6. LIMITATION OF DAMAGES AND IMPLIED WARRANTIES

ENERMAX CORPORATION SOLE LIABILITY FOR ANY DEFECTIVE HARDWARE PRODUCT IS LIMITED TO THE REPAIR OR REPLACEMENT OF THE PRODUCT AT OUR SOLE OPTION. UNDER NO CIRCUMSTANCES WILL ENERMAX CORPORATION BE LIABLE IN ANY WAY TO THE END-USER FOR ANY DAMAGES IN CONNECTION WITH THE HARDWARE PRODUCT OR ITS SALE, PURCHASE OR USE. INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF USE OF THE HARDWARE PRODUCT OR ANY ASSOCIATED PERIPHERALS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGE WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT BASED ON BREACH OF WARRANTY, CONTRACT OR NEGLIGENCE, EVEN IF ENERMAX CORPORATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

All implied warranties are limited in duration to the warranty period. All such implied warranties are expressly disclaimed for periods beyond the warranty period. Some jurisdictions do not allow limitations on the duration of an implied warranty, so this limitation may not apply to you.
